Das #Bundesverwaltungsgericht hat entschieden, dass das #CookieBanner auf ORF.at angepasst werden muss.
Der farblich hervorgehobene „Akzeptieren“-Button bei nicht gleichwertiger „Ablehnen“-Option verstößt gegen die #DSGVO und kann zu ungewollten Einwilligungen führen.
Die Beschwerde brachte die Datenschutzorganisation #noyb ein. Die Entscheidung dürfte Signalwirkung für viele Unternehmen haben.

Lustige Erkenntnis nach drei Stunden Cookie-Banner klicken: Die "berechtigten Interessen" der 847 Werbepartner sind offenbar so berechtigt, dass man sie einzeln abwählen muss. Der "Alle akzeptieren"-Button leuchtet derweil wie ein Weihnachtsbaum. 🎄
Reject-All-Button als Pflicht wäre nicht nur nutzerfreundlich, sondern eigentlich schon lange DSGVO-konform. Just saying.

Mich nervt es, wie immer wieder Menschen sagen, eine datensparsame #Altersverifikation wäre möglich. Theoretisch stimmt das ja: Der Anbieter fragt nach einem Nachweis, man wählt #BundID, man meldet sich mit dem Perso an und lässt nur die Info weitergeben, dass man über X Jahre alt ist, und sonst nix. Kein Name, kein Geburtsdatum, kein sonstwas.
Aber wer hat ein Interesse daran, außer den Nutzenden? Die Plattformen wollen mehr Daten an ihre Werbekunden verkaufen und Moderationsaufwand senken. Die regierenden Politiker wollen sowieso #Klarnamenpflicht und sind für jede Überwachung zu haben.
Wann hat das je zu einer datensparsamen Umsetzung geführt? #ePA: Katastrophe. #CookieBanner gibt es immer noch. Strafzahlungen gg Meta und co sind ein Witz.
Einziger Lichtblick: die Corona-Warn-App.
