Das war ein ausgezeichneter Vortrag von Lena #Herbst von der @tubraunschweig zur #UN-#Cybercrime-Konvention. Beim #BIGS-PizzaSeminar ist sie auf den Verlauf der Verhandlungen, die Positionen und Konfliktlinien, die Einbindung nichtstaatlicher Akteure, den erreichten Konventionstext und die anstehende Implementierung der Konvention eingegangen. Dabei hat sie auch ganz aktuell von der Sitzung des “Ad Hoc Committee to prepare the draft text of the rules of procedure for the Conference of the States Parties to the UN Convention against Cybercrime” am 26-30 Jänner in Wien berichtet.

Nun ist es an der @Bundesregierung zu entscheiden, ob und wie sie die Konvention unterzeichnen möchte. Und der @bundestag muss entscheiden, ob er die Konvention ratifizieren will.

The UN General Assembly is set to vote on the proposed UN Convention Against Cybercrime this month. The treaty is opposed by many human rights and civil liberties organizations. But @AnjaPJakobi and Lena Herbst argue in a new @PRIF paper that an acceptance with a declaration of reservations would still be the best way forward.
"Without internal critics, the ‘Conference of Parties’ (CoP), tasked with reviewing and implementing the convention, could develop additional measures and worsen a convention that at least includes some human rights safeguards. [...] If reviews of the treaty show that its implementation means compromising human rights and data protection, states should continuously reevaluate whether to stay or leave the treaty, with the Budapest Convention as a remaining fallback option."

Emmanouil Metaxakis of the "Hellenic Police Academy" speaks plainly in the newest issue of the International Cybersecurity Law Review: Greece ratified the Budapest Convention through Law 4411/2016.
