Czytam o ambasadorze USA w Polsce, panu Marku Brzezińskim.
Ambasadorem państwa obcego w Polsce nie może zostać osoba posiadająca obywatelstwo polskie. Pan Marek Brzeziński, jako syn Zbigniewa Brzezińskiego, który nigdy się obywatelstwa polskiego nie zrzekł, zgodnie z polskim prawem, od urodzenia jest obywatelem polskim. Prawnicy rządowi, chcąc wyjść z impasu, uznali, że Marek Brzeziński, zgodnie z postanowieniami Konwencji między Polską Rzecząpospolitą Ludową a Czechosłowacką Republiką Socjalistyczną o uregulowaniu zagadnień dotyczących podwójnego obywatelstwa, sporządzonej w Warszawie dnia 17 maja 1965 r. uznali, że Marek Brzeziński, którego matka była Czeszką, jest obywatelem czeskim. Należy jednak zwrócić uwagę na fakt, że Marek Brzeziński urodził się 7 kwietnia 1965 roku, zatem przed wejściem w życie ww. Konwencji i nigdy, żyjąc w USA, gdzie Konwencja nie dotknęła go bezpośrednio, nie dostosował się do jej postanowień. Co więcej, Konwencja została wypowiedziana przez Polskę w 2000 roku, na długo przed powołaniem się na nią przez rządowych specjalistów. Innymi słowy, prawnicy uznali Marka Brzezińskiego za Czecha powołując się na uchylone przepisy. Marek Brzeziński nie zrzekł się też nigdy obywatelstwa polskiego, ponieważ, jak twierdził, nic mu nie było wiadomo, aby takie posiadał. Zobowiązał się tylko do nie ubiegania się o polski paszport, co w zasadzie jest bez znaczenia. Zgodnie z powyższym należy uznać, że Marek Brzeziński jest obywatelem polskim i nie może pełnić w Polsce funkcji ambasadora żadnego innego państwa.
To oczywiście teoria. W praktyce: dajcie człowieka, a paragraf się znajdzie.
