Speaking at the House of Commons of #Canada this Wednesday, FCJ Refugee Centre’s In-House Lawyer, Joshua Eisen, highlighted the need for regulatory exceptions to the new ineligibility provisions introduced by Bill C-12; and denounced “the extraordinary and unjustifiable delays” for Humanitarian and Compassionate applications, which according to IRCC now stand at more than 10 years.
Eisen spoke as a witness at the Standing Committee on Citizenship and Immigration (CIMM).

Since Bill C-12 passed, some refugee claimants are receiving ineligibility letters from IRCC. The letter states that if found ineligible for referral to the Refugee protection, you will face removal from Canada. But being found ineligible to continue your refugee claim with the RPD, DOES NOT MEAN AUTOMATIC DEPORTATION. It is likely that you will be invited to apply for a PRRA.

Well. Senate debate on C-12 is over. The bill has now gone back to the House with two amendments- but to my sorrow, all our other amendments failed. Still, I’m proud of the two dozen or so senators from all parts of the Chamber who stood together to fight for justice for immigrants, refugees, international students and those on work visas. We made our arguments with passion, reason, evidence and courage. I hope courts will take note in the future. #C12 #BillC12 #cdnpoli #Canada #immigration

I had less luck with the amendment I proposed tonight, to try to put some meaningful parliamentary oversight on the mass cancellations of visa and permanent residency cards. As FCJ Refugee Centre said at the Senate, "Bill C-12 will result in a refugee system that is more inefficient, more arbitrary, less fair, and less humane." The committee's recommendation is, therefore, an important step. However, it is not definitive: its recommendations are not binding. The committee with the final say, the SECD, began its review this Monday, with a deadline of February 26.Now more than ever, it is essential to keep up the pressure.
