  6. This bill could change everything for American Creators and our Freedom of Expression, but it has gotten so little attention.

    H.R. 4678 The Restoring Artistic Protection Act, introduced by Rep. Hank Johnson (D-GA), would create a strong legal presumption that creative works cannot be used as evidence in federal criminal or civil cases.

    It covers all creative expression, including:

    • Video Games
    • Comics & Animation
    • Movies & TV Shows
    • Books & Literature
    • Visual Art & Scripts

    Fictional storylines, characters, dialogue, artwork, and gameplay would be presumed inadmissible. Prosecutors could only overcome this with a pretrial hearing and clear and convincing evidence that it’s directly relevant, not just character assassination.

    No more treating art as confession.

    This would give game devs, comic artists, animators, and filmmakers real breathing room to create bold, raw, and unfiltered content without lawsuit chill.

    It currently has 21 Democrat cosponsors, but something this important needs bipartisan support and hearings in Judiciary. Similar protections have already passed in Georgia, Louisiana, and Missouri with Republican backing.

    After 15+ years, Americans are tired of watching their sanitized culture wither away while other countries continue to make great works for the world to enjoy, we want to have pride in the art that our country produces, and it is high time that American creators were able to build freely and without fear again.

  10. A Clemens Clap Back

    A very complex person who made considerable observations on humanity was Samuel Clemens. His commentary and short stories, one of which he published as the diary of Eve, pushed the limits of censorship at the time. This statement to the press after his congressional testimony on copyright in 1906 is very fascinating. He was asked about images of Eve used in his book and the banning of this work by a library.

    “The whole episode has rather amused me. I have no feeling of vindictiveness over the stand of the librarians there—I am only amused. You see, they did not object to my book; they objected to Lester Ralph’s pictures. I wrote the book; I did not make the pictures. I admire the pictures, and I heartily approve them, but I did not make them.

    It seems curious to me—some of the incidents in this case. It appears that the pictures in Eve’s Diary were first discovered by a lady librarian. When she made the dreadful find, being very careful, she jumped at no hasty conclusions—not she—she examined the horrid things in detail. It took her some time to examine them all, but she did her hateful duty! I don’t blame her for this careful examination; the time she spent was, I am sure, enjoyable, for I found considerable fascination in them myself.

    Then she took the book to another librarian, a male this time, and he, also, took a long time to examine the unclothed ladies. He must have found something of the same sort of fascination in them that I found. Now, if the pictures were so good as to occupy their attention so long, it seems to me that they were a little selfish not to permit the rest of the city a chance instead of shutting the volume out.”

  11. I wanted to offer a website to sell the photos from my exhibition, but I realized I wasn't going to sell many, so I didn't want the hosting to cost much.

    To achieve that, I created the site as a static html website, including the shopping basket, written in fairly minimalist javascript.

    For payments, I knew I'd need a third party, after a bit of reading I chose stripe.com. I chose them because they seemed be easy to integrate with and have fairly minimal fees.

    Stripe does require a server side, so I built that using a cloud "lambda" type function, that receives the data from the website via HTTP Post and form data. There's some minimal processing in the lambda then stripe takes over.

    I'm pleased to have produced a micro-ecommerce site, that can be host on a free plan from one of the big cloud providers.

    I think I'm going blog and about the approach and may be to try and create a kit to help others do the same. I would nice to see artist able to host there own work, rather than having to pay a third party website to do so.
