  7. .@CenDemTech's Eric Null in Lawfare: "The House Energy & Commerce Committee made the right call to cancel its markup of the updated #APRA, which lacked vital & necessary protections for civil rights & algorithmic transparency that were included in prior bill drafts:" law360.com/publicpolicy/articl

  8. @dell looks at the #APRA dynamics in @WIRED

"The decision to cancel the hearing came amid news that House GOP leaders had vowed behind closed doors to scuttle the bill whether it was approved by the committee or not. But while the power of the pen ultimately rests in Republican hands, eighty-sixing Thursday’s session has also saved many Democrats from having to make the difficult decision to support a bill that was recently stripped of crucial civil rights protections....

While Republicans who staunchly oppose the most rigorous of protections—favoring, as they say, a more “pro-business” approach—held the real power to decimate the bill, House Democrats have been under intense pressure as well to see it dead. As one reporter familiar with the bill’s trajectory through the House described the text on Wednesday: “Everyone hates it.”

APRA had by Tuesday lost the support of dozens of major privacy and civil liberties groups across the country. Organizations such as the American Civil Liberties Union and the Center for Democracy & Technology stated they could no longer support APRA after E&C lawmakers this week cut several key provisions aimed at protecting vulnerable members of society from discrimination and harmful byproducts of AI-driven technologies.

Dozens of civil rights organizations had been urging Democrats (some of whom had puzzlingly signed off on those changes) to sink the bill, arguing that the changes were both “immensely significant and unacceptable.”

  9. Today's House Energy & Commerce #KOSA and #APRA markup was cancelled at the last minute. That's ertainly better then them advancing either of the bills.

    - KOSA, as as EFF and others point out, is still an anti-LGBTQ+ censorship bill. eff.org/deeplinks/2024/05/us-v

    - the latest version of APRA privacy bill eliminated civl rights safeguards, and created a huge new loophole for on-device data, so privacy and civil liberties groups now all oppose it. freepress.net/news/press-relea

So far, the only coverage I['ve seen of the cancellation is from Cristiano Lima-Strong on Xitter. x.com/viaCristiano/status/1806

  10. Federal lawmakers pulled civil rights protections from #APRA (the proposed federal data #privacy law) because Ted Cruz said they were too woke. Now most of the bill's supporters are opposing it techpolicy.press/us-congress-m

  12. CCIA has long advocated for comprehensive federal #privacy legislation, however, the current draft of #APRA creates more uncertainty – considerable updates are needed before moving the bill forward.

CCIA released a set of #privacy principles to inform policy makers when developing federal privacy legislation, learn more: buff.ly/41shvgf

  13. We also hope that the Senate Commerce Committee moves #APRA simultaneously and expeditiously, given there is limited time left in the legislative year. But for now, we are committed to working with Congress to advance strong comprehensive privacy protections for all Americans.

  14. The bill is not perfect. Some of CDT’s reservations include how advertising, particularly cross-contextual behavioral advertising, appears to be treated. We hope those issues, among others, get fixed before #APRA passes out of the full committee.

  15. This vote is a crucial and positive step in moving comprehensive #privacy legislation through Congress. #APRA

  16. The latest version of #APRA
seems to contain language from #COPPA 2.0. While we think the best way to protect kids is to address the fundamental harms of surveillance capitalism by passing a privacy bill that protects everyone, we don't have the same censorship concerns w/ COPPA

  17. There were some worries that #KOSA would be attached to #APRA. So far it seems like that isn't happening. So there is a clear path for lawmakers to improve and pass a strong privacy bill rather than advancing a dangerous and controversial censorship bill.

  18. There's some good news about the hearing tomorrow. The committee is also marking up #APRA. We think this bill needs to be strengthened, and we're concerned about pre-empting state laws and FTC rulemaking, but we generally think a privacy bill is way better idea than #KOSA.

  19. My data protection assessment of TLS Session Tickets. While they are a unique identifier, all is OK. No consent needed. Another conclusion would mean that the data protection rules are inherently inadequate and harmful. #GDPR #ePrivacy #CCPA #APRA blog.lukaszolejnik.com/tls-ses

  20. But congress also has a way weaker option in a bill called #APRA. Those provisions pretend to be the DELETE Act, but actually fine data brokers less $$ than it would cost to do opt-outs, and it would require that we opt out of 500+ individual websites.

    Total nothingburger.

  21. The good news is we are the closest we've ever been to passing the #DELETEAct or getting it added to (currently toothless on data broker opt-outs) #APRA.
