Media is reporting the U.S. Administration has walked away from legal battles with four law firms - Perkins Coie, Wilmer Cutler Pickering Hale and Dorr, Jenner & Block and Susman Godfrey.

The firms were recently notified that the U.S. administration was dropping its appeals - no explanation provided, and the Department of Justice is not talking. Enough said! notus.org/courts/trump-adminis #USGov #Lawsuit #LawFirms #Coersion #Appeals

  5. @w7voa And rushing to Alina Habba's rescue is a WH aide. He stealthily heads to SCOTUS' back door, hands an emergency request form to a robed and masked John Roberts who exchanges it for an already filled out form putting a hold on the lower courts' decisions. Alina can now lawfully continue to be unlawful. #Appeals #AlinaHabbas #SCOTUS #Trumpattorneys

  9. #Kavanaugh's concurring opinion notes that district courts do not have the last word on preliminary #injunction requests -- courts of #appeals & #SCOTUS can also weigh in, & "that order of operations will not change." [which is why they should have the ability to apply nationwide & the power to rule an executive action is illegal. FFS]

  10. This week, in #Hernandez et. al. v. City of Los Angeles (docket no. 21-55994), the US Court of #Appeals for the Ninth Circuit chipped away at the misguided #legal principle of #qualifiedImmunity. The case involved a female officer, Toni McBride, who put six bullets in a suspect—the last 2 of which were fired while the suspect was "rolling on the ground".

In a 6-5 en banc decision, the court overturned a 3-judge panel's ruling that qualified immunity protected (now former) Officer McBride, based on a horrifying 2017 precedent from Orange County in which a Sheriff's Department officer essentially executed a prisoner, firing six shots into him after he'd already been hit several times and was lying on the ground. (In the earlier case, Zion v. County of Orange, the officer then stomped on the mortally wounded suspect's head.)

It's always good news when cops are held to account for their actions.

  12. My bad-ass wife just won another appeal—this one for a class-action suit against a debt collector.

"The appearance of impropriety exists when the trial judge adopts verbatim one party's one-sided final judgment, especially where the judge did not
orally announce findings or rulings during or at the end of trial."

  13. Background:

US District Judge Boasberg issued a TRO prohibiting the government from deporting #migrants under the Alien Enemies Act (passed in 1798 as part of the legislative package historians refer to as the Alien & Sedition Acts).

In an extraordinary move (albeit one that this administration is frequently employing), defendants (the government) appealed the TRO. A TRO (temporary restraining order) is normally not appealable.

    Result:

Today, a 2-1 ruling by a panel of the US #Court of #Appeals for the District of Columbia slammed the government's case, finding it "unlikely" that the government would prevail in a full hearing on the merits. The court declined to reverse the TRO.

The dissenter is a judge appointed by #RedDon in his first term.

This is all procedural jousting. Though highly consequential, it's preliminary to a hearing and final judgement on the merits of the suit itself.
