“Meta’s settlement with 52 state attorneys general is a bad deal for all internet users, and especially for teens. That’s what we said the day the settlement was announced.
In this post, we go through the Settlement’s provisions in detail and explain why that is so, including how:
- The Settlement embeds age assurance technology and age-gates into Meta’s social media products and requires all users—minors and adults—to undergo a rights-threatening age estimation process
- The Settlement places severe restrictions on Teens that can largely only be modified by the Teens’ parents and only then in exchange for giving their parents a ton of information about their online community and usage;
- The Settlement seems to empower the attorneys general to enforce Meta’s content restriction on “age inappropriate content,” categories that Meta itself has had trouble administering without excluding information about sexuality, sexual and reproductive healthcare, and abortion medication;
- The Settlement actually requires Meta to collect, analyze, and retain more information about its Teen users—when the pressure should have been on Meta to diminish its surveillance capitalism.
- And the Settlement in no way limits the attorneys general from seeking the user information for their own law enforcement purposes.”

I still don't like the idea of mandatory #AgeVerification, as it's extremely difficult to do without making it a form of surveillance unless you're willing to accept a lot of false negatives.
Amazingly, the California legislature seems to have fixed a lot of the problems in last year's law with an amendment that passed unanimously.

It limits the scope drastically. Things like apt no longer fall under its definition of an app store. It no longer assumes every computer is going to have a cloud account. Open source/Free Software are explicitly excluded, as are app extensions like browser add-ons.
It extends a good-faith safe harbor for the case where someone fakes their age signal and the service sees, incorrectly, that they're in the right bracket. And it prohibits requesting those signals where not required by law.
The two good things about the original law were that it limited collection to age ranges and not exact ages, and that it allowed the covered services to take the primary user's word for it. Still exploitable if your kid plays online games right before and after their birthday, but it didn't mandate detailed data collection, or third party certifiers that could get hacked or otherwise abused, no biometrics to get loose, and only a very weak fingerprinting signal.
It's not perfect. But it's a hell of a lot better than the poorly thought-out piece of trash that was passed last year, and it's a lot better than some of the draconian stuff I've seen proposed elsewhere.

Officially Linux or other strictly open source licensed #operatingsystems are except from os verification laws the u.s. At least in California.
So as a User of tech you can just use that and never have to age verify at the os level.
However this doesn't yet get a clear answer for federated mastodon or other #activitypub services. There's still uncertainty.
But due to the decentralized nature you can as a user can just pick a specific hosted location whether a specific u.s state or a country that might not legally require an age verification.

When you realize a lot of the #ageverification has to do with #operatingsystems, social media and adult content. (And even AI chat bots)
What does all this have in common? Being connected to the Internet or cellular. What doesn't it effect.
Offline tech with zero app stores and zero downloadable content in an 'official' means for said hardware.
By using software on an offline device think DVD players or long pass discontinued devices like the Xbox 360 ps3 or Wii consoles with no official manufacture support or updates.
You as the user are legally in the clear you aren't responsible for not age verifying if said device is officially offline and unable to have any downloads officially not even let's say Nintendo would be in legal trouble if you were to put any type of app on it via homebrew you as the user wouldn't be either.
Modding an unsupported device is safer then using a device like a new Android phone if your trying to avoid age verification checks long term.
Any services you use that are online at at risk at the daily to force users to age verify. Duckduckgo? It's a matter of time.
Where you might have more leeway with this however is the complexity of Mastodon servers, Misskey servers, not all being centralized. Which can make it harder for the law to keep up with each individual server.
Android as a platform is liable, iPhone is liable, but if you're modding say an older psp that is better protected from age verification laws just because it's officially discontinued by Sony. Official online services and all.

Linux is thankfully being given an exemption from the new Californian legislation forcing operating systems to do compulsory age verification.
From the article “These amendments redefine the term “operating system provider” to exclude any person or entity that distributes an OS or application “under license terms that permit a recipient to copy, redistribute, and modify the software.”
Obviously any software where the users has full power to change the code was never going to be able to stop users from opting to rip out government code no matter how much legislators wished it might stay in there.
Good to see they finally came around to the lack of workability to what they were hoping to enforce.
May the march to Linux continue.

This is NOT a victory, this probably makes OSS a second class citizen once websites and services require age verification integration points.
Not to mention this is just a delay tactic, they hope the nerds go back to sleep and don't talk about our rights being eroded.
