  15. "Pay or Okay user study. The law requires that users have a “genuine or free choice”. To find out if this right is respected, noyb has commissioned an academic study about user choices. Even though participants did not need to make any real payments during the study, the results are still clear:

    - When asked openly, only about 2 out 10 people agree with companies collecting and analysing their data.
    - However, when they face “pay” and a “consent” option, about 9 out of 10 people chose “consent”. The high consent rate seems to be caused by the lack of a reasonable alternative.
    - Finally, when there’s a “pay”, a “consent” and a “advertising, but no tracking” option, most users switch to the latter. 7 out of 10 people then choose the “advertising, but no tracking” option.

    This shows that the “third option” (as suggested by the EDPB) is supported by objective evidence: Users accept funding of websites via advertising – but not online tracking.

    No difference between different sites. The study also shows that users do not behave differently depending on whether they are on large social networks, journalistic pages or other websites. Therefore, there is no factual basis to treat these websites differently and, e.g., create different Pay or Okay guidelines for media websites than for social media.

    “Privacy fee” vs “paying for a service”. With Pay or Okay, users are required to pay a privacy fee if they want to retain their right to online privacy. While website providers can, of course, ask for payment in exchange for access to content or a service they provide (like Netflix for TV shows or Spotify for music), Pay or Okay systems try to charge users for their data protection rights without compensation. Unfortunately, even the French Data Protection Authority confuses this, referencing a survey in a bid to support Pay or Okay."

    "Microsoft has quietly launched a new version of Microsoft Office for Windows that can be used to edit documents for free, no Microsoft 365 subscription or Office license key required. This free version of Office is based on the full desktop apps, but has most features locked behind the Microsoft 365 subscription.

    First spotted by Beebom, the free version of Office for Windows includes ads that are permanently on screen when within a document in Word, PowerPoint, and Excel. Additionally, this new free version of Office also only allows you to save files to OneDrive, meaning no support for editing local files.

    To access the free version of Office, just skip the prompt to sign-in when you first run an Office app. From there, you will be given the choice to continue to use Office for free in exchange for ads and limited features.     Today’s decision arises from enforcement by the Belgian Data Protection Authority, prompted by complainants coordinated by Dr Johnny Ryan, Director of Enforce at the Irish Council for Civil Liberties.     This Belgian enforcement arises from a chain of complaints and litigation across Europe initiated by Dr Ryan in 2018 against Real-Time Bidding (RTB)."

  43. "While I once hoped 2017 would be the year of privacy, 2024 closes on a troubling note, a likely decrease in privacy standards across the web. I was surprised by the recent Information Commissioner’s Office post, which criticized Google’s decision to introduce device fingerprinting for advertising purposes from February 2025. According to ICO, this change risks undermining user control and transparency in how personal data is collected and used. Could this mark the end of nearly a decade of progress in internet and web privacy? It would be unfortunate if the newly developing AI economy started from a decrease of privacy and data protection standards. Some analysts or observers might then be inclined to wonder whether this approach to privacy online might signal similar attitudes in other future Google products, like AI.

    I can confidently raise this question, having observed and analyzed this area for over 15 years from various perspectives. My background includes experience in web browser security and privacy, including in standardization. I served in the W3C Technical Architecture Group, and have authored scientific papers on privacy, tracking, and fingerprinting, as well as assessments of technologies like Web APIs. This includes the Privacy Sandbox’s Protected Audience API. I was looking forward to the architectural improvements of web privacy. In other words, I am deeply familiar with this context. The media so far have done a great job bringing attention to the issue, but they frame this development as a controversy between Google’s policy change and the UK ICO’s concerns. I believe that the general public and experts alike would benefit from a broader perspective."
