DA argues that all of the caselaw presented that mentions appearance of impropriety & that ruled to DQ also proved actual conflict. There is no caselaw where only appearance led to disqualification.
[I’d also have argued that these cases only have impropriety between the prosecutor & a party to the case or a witness, not a co-#attorney]
