    Anime in pena. Regimi punitivi nella storia

    Di recente, diverse studiose e diversi studiosi hanno affrontato la storia della penalità ponendo al centro delle proprie indagini un’accurata analisi dei regimi punitivi, ossia di quel vasto arcipelago di pratiche, consuetudini, norme e istituzioni che contribuiscono a definire e a reprimere i soggetti e le categorie considerate devianti e/o inferiorizzate (C. Lucrezio Monticelli e C.G. De Vito 2021).

    Questa prospettiva ha consentito di ricondurre l’analisi, spesso invece separata e disgiunta, di singole modalità punitive quali la carcerazione, la reclusione correzionale o la deportazione penale, all’interno di interpretazioni più ampie, capaci di mettere in luce gli elementi di continuità e di discontinuità tra una configurazione punitiva e l’altra.

    Sulla scia di questi studi, il numero che qui si propone - ideato a partire dal dibattito sviluppatosi a margine di un dialogo presentato nell’ambito del XVII SIMposio (2023) e intitolato La fine della pena? Ergastolo e sistemi punitivi in Italia - intende guardare alle trasformazioni che, nel tempo, hanno determinato il divenire di questi dispositivi.

    Rispetto al focus del dialogo, si è pensato di allargare lo sguardo e le prospettive di analisi per evitare di rimanere strettamente legati alla questione dell'ergastolo e del 41 bis. L’ambizione è infatti quella di superare gli stretti confini del carcere per analizzare i processi di ridefinizione di dispositivi penali e modalità punitive in svariati contesti, da quello propriamente penale a quello familiare, da quello lavorativo a quello educativo.

    Più precisamente, il numero vuole analizzare in che modo e secondo quali traiettorie i soggetti sottoposti a determinati trattamenti disciplinari, la comunità civile e i movimenti sociali abbiano contribuito alla sopravvivenza, alla riforma, al superamento o all’abolizione dei differenti regimi e dispositivi di pena, coercizione o correzione.

    Alla varietà dei casi di studio si vuole poi accompagnare una prospettiva cronologica di medio-lungo periodo capace di muoversi dagli ultimi decenni del XVIII secolo fino ai giorni nostri, su una spazialità quanto più possibile diffusa. In quest’ottica,
