  17. It's not about weddings. Or religion.

    My take of the #303Creative decision is that the state cannot enforce anti-discrimination laws to compel speech, or expressive conduct in violation of that person's beliefs. Period.

    Though the parties' stipulation, and #SCOTUS took great pains to point out that the plaintiff would serve the LGBTQ community other than wedding websites, that appears to be a red herring.

    Replace anti-gay with racist. Could a nazi who does not believe those of other races should be allowed to marry be forced to create a wedding site for a black couple?

    And take this a step further - if a racist believed a racial minority was subhuman and should not be allowed to conduct any business, why would the 303 Creative decision not protect him for refusing to create any website for racial minorities? Or atheists? Or Christians?

    It seems that applying anti-discrimination laws to any speech, or expressive conduct, is now arguably unconstitutional.

    Good Lord! The fact that 303 Creative LLC v. Elenis was decided on a lie is galling AF.

    But be absolutely clear that does not matter no matter how many posts you see about it on social media. The Supreme Court makes the rules. They aren't going to re-hear the case. They aren't going to change their mind. Not this court.

    Even if they did, the best the SC would do is void the decision and then make the exact same decision for another case.

    The decision may eventually be overturned, but the only real way that's going to happen is a change in the makeup of the court and someone else bringing a case designed to overturn it.

    There's going to be no Supreme Court perjury case either. This case isn't going to get overturned on any kind of technicality.

  29. The more I read about the #303Creative decision the more bonkers it is.
    - The request to design a website never happened.
    - The alleged requester is straight, married, and the same-sex spouse doesn’t exist.
    - The plaintiff never designed any sites, and in fact was only contemplating starting the business.
    - The actual complaint is that she wanted to open the business but was scared that a gay couple would ask for one and she’d be punished for refusing.

    How did this get to the #SupremeCourt?!
