    Committee to Protect Journalists urges Austrian authorities to explain detention of UP journalists

    The Committee to Protect Journalists (CPJ) has urged Austrian authorities to urgently explain why Mykhailo Tkach, head of investigative journalism at Ukrainska Pravda, and cameraman Yaroslav Bondarenko were forcefully detained in Vienna on Thursday.

    Details: Fiona O'Brien, CPJ's regional director for Europe and Central Asia, said there is a lack of transparency regarding the detention.

    Quote: "It is shocking to hear of two journalists being detained in such an aggressive manner in a European capital city, and with so little transparency as to why they were held for so long and questioned. While we are relieved to see that both Mykhailo Tkach and Yaroslav Bondarenko have now been released, we call on the Austrian authorities to provide a full explanation as to why they were treated this way."

    • Tkach said that armed masked men smashed the windows of his car and dragged him and Bondarenko out onto the road as they were arrested in Vienna. One of the men then knelt on Tkach's neck as he repeatedly insisted he was a journalist.

    • The journalist also said that they were accused of three offences following their detention in Vienna: espionage on behalf of Ukrainian military intelligence, involvement in a criminal organisation and causing harm to Austria.

    Espionage, criminal organisation and harming Austria: UP journalist Tkach reveals allegations against him in Vienna

    Mykhailo Tkach, head of Ukrainska Pravda's investigative journalism department, has said that he and cameraman Yaroslav Bondarenko were accused of three offences after being detained in Vienna: espionage on behalf of Ukrainian military intelligence, participation in a criminal organisation and causing harm to Austria.

    Quote: "At the beginning of the interrogation, I was given a document to sign. As I understand it, it was the equivalent of a formal notice of suspicion. It listed three allegations against us. One was espionage on behalf of Ukrainian military intelligence. Another was participation in these activities, which was classified as involvement in a criminal organisation. The third allegation, as far as I remember, concerned causing harm to Austria."

    Details: Tkach said that during the questioning, law enforcement officers did not explain the grounds for the accusations. As it progressed, he concluded that there was no evidence against him or his colleague.

    Quote: "We had worked in Vienna many times, always in public places, covering public figures and people about whom information was in the public interest. So hearing such allegations came as a shock to me."

    Details: Tkach described what happened as an "extraordinary misunderstanding". Tkach also suggested that the detention might have resulted from information provided to Austrian law enforcement officers, possibly through manipulation.

    He said the first round of questioning lasted around two hours. A Ukrainian consul arrived afterwards, which gave the journalist an opportunity to tell him about his detention. The questioning then resumed.

    Tkach thanked Ukrainian diplomats for their assistance, noting that, in his view, their intervention had helped significantly.

    "We were detained like terrorists": UP journalist Mykhailo Tkach details circumstances of detention in Vienna

    Mykhailo Tkach, head of Ukrainska Pravda's investigative journalism department, said that masked, armed men smashed the car windows and dragged him and cameraman Yaroslav Bondarenko onto the road during their detention in Vienna.     Quote: "It felt like we were being treated as terrorists. They didn't speak to us at all. There was just this shocking amount of shouting – everyone was yelling and pointing their weapons at us, and there was virtually no communication."

    Details: Tkach said he and Bondarenko were driving between filming locations when their car stopped at a traffic light about 3-5 km from central Vienna. Seven masked, armed men then ran up to the car, smashed its windows and pointed their weapons at the journalists.

    He added that he immediately raised his hand and told the men he was a journalist. They then pulled both men from the car, forced them face down onto the road, searched them and taped their hands behind their backs.

    Quote: "I repeated, kept repeating, that I was a journalist, but one of the men knelt on my neck and shouted at me to shut up.

    Then they dragged me – there was an archway nearby – dragged me into this archway, pulled my face against the wall again and told me to shut up."

    Details: According to Tkach, the masked men who detained him did not identify themselves or explain what they were doing. He saw no badges and did not immediately notice any police markings, so for the first 30-40 minutes, he believed he and Bondarenko had been abducted.

    He said he realised the men were police officers only when they led him out of the archway and he saw police cars. The journalist was then placed in a separate compartment of a minibus, which drove off with its sirens on for about 20 minutes.

    Tkach said he has not seen Bondarenko since their detention. He recalled seeing shards of glass from the smashed car window fly into the cameraman's face.

    At the police station, Tkach had all his belongings confiscated, was ordered to remove his shoes and was placed in a solitary cell. He said he waited there for about two hours without any explanation, despite repeatedly asking officers why he had been detained. A doctor also visited him during that time to ask how he was feeling.

    The Ukrainian media community demands that the Austrian authorities investigate the actions of the police during the detention of the UP film crew.

    The statement was signed by representatives of almost 30 Ukrainian media and public organizations.

    The authors of the document insist that conducting a journalistic investigation, in particular against public officials, cannot serve as a basis for intimidation, arbitrary detention or obstruction of professional activities.

    The media community demands from the Austrian authorities:
    ▪️ conduct an urgent, independent investigation into the detention of journalist Mikhail Tkach and cameraman Yaroslav Bondarenko;
    ▪️ check the legality of the force used, bring the perpetrators to justice;
    ▪️ return seized equipment to journalists and provide them with full access to legal and medical assistance;
    ▪️ provide the Ukrainian public with official explanations of this situation.

    “Ukrainian journalists are already working under extreme threats due to Russian aggression. It is unacceptable that, while carrying out professional work in democratic European countries, they are faced with a disproportionate use of force and unreasonable restrictions on their rights,” Ukrainian media professionals say.

    Two Ukrainians alleged to be military intelligence personnel remanded in custody in Vienna

    Der Standard has reported that two men suspected of working for Ukraine's military intelligence were arrested in Vienna on Monday 5 October and remanded in custody on Wednesday 7 October on suspicion of espionage. The report comes alongside news of the separate detention of Mykhailo Tkach, head of Ukrainska Pravda's investigative journalism department, and cameraman Yaroslav Bondarenko on Thursday 8 October.

    Details: Two alleged Ukrainian military intelligence personnel were detained in Vienna on Monday. On Wednesday, the regional court ruled to remand the suspects in custody.

    Court spokesperson Christina Salzborn said on Friday that the grounds for remanding the two men in custody were the risk of further offending, tampering with evidence and absconding. The remand order is initially valid until 21 October.

    Both men deny the charges brought against them.

    The journalist was detained while carrying out an editorial assignment. Together with Tkach, his colleague Yaroslav Bondarenko was in Austria (his whereabouts are unknown to the editorial office).

    The editors called this detention illegal and demand his immediate release and explanations from Austrian law enforcement officers.
