What is this about sir?
implementation Personal Data Protection Law (UU PDP) after nearly three years since the last public draft.
The regulation differs from the 2023 draft in two main ways:
- More flexibility: Detailed audit requirements—particularly for processor audits—have been scaled back, allowing organizations to use more risk-based compliance approaches while still supervising parties involved in data processing.
- Stricter, clearer limits: CCTV use in public places and public service facilities is expressly limited to purposes such as security, disaster prevention, and traffic management. Cameras generally should not be used to identify individuals, except in specified law-enforcement situations.
Companies should reassess compliance programs developed under the 2023 draft, especially their use of CCTV, facial recognition, visual analytics, and audit controls. The next anticipated development is a Presidential Regulation establishing the national data protection authority.
