Article 1 clarifies, strengthens, and expands the scope of the offense of inciting acts of terrorism or publicly glorifying such acts, an offense defined in Article 421-2-5 of the Penal Code and punishable by five years' imprisonment and a fine of €75,000. The aforementioned article now requires direct incitement to constitute this offense.Firstly , it is proposed to also punish indirect incitements, the penal code frequently using the adverbs "directly or indirectly" to define various offenses.
Secondly , it is proposed to impose sanctions on:
– public statements presenting acts of terrorism as legitimate resistance [...]– the act of publicly inciting people to pass a favorable judgment on acts of terrorism or on their perpetrators. Thus, the glorification of terrorism would be systematically sanctioned, in accordance with established case law [...]
